Terms of Use

These Terms of Use (“Terms”) apply to all sale and purchase of goods (“Goods”) effected through online shops operated on websites owned and/or operated by King Fook Jewellery Group Limited (“KFJ”, “us”) (collectively, “Websites”). We provide its service to you subject to the following Terms, which may be updated by us from time to time without notice to you. To the extent of any discrepancy or inconsistency between the Terms, the Jurisdiction Specific Terms, the Website Terms, and/or the Privacy Policy Statement, the order of precedence will be the Jurisdiction Specific Terms, these Terms, the Website Terms of Use and the Privacy Policy Statement. To the extent of any discrepancy or inconsistency between the English and the Chinese versions of the Full Set of Terms, the English version will prevail.

1. Registration

To use the Services you will need to register an eShop account. Upon successful registration of your eShop account, you will also become a member instantly. Therefore, by registering an eShop account in the Site, you agree to be bound by the Terms and Conditions as well. In consideration of your use of the Service, you agree to:

A. Provide true, accurate, current and complete information about yourself as prompted by the Service's registration form (the "Registration Data") and
B. Maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current, or incomplete or misleading, or we have reasonable grounds to suspect that such information is untrue, inaccurate, not current, incomplete or misleading, we have the right to suspend or terminate your account and refuse any and all current or future use of the Service (or any portion thereof). We are concerned about the safety and privacy of all users, particularly children.

2. Account Security

After you have completed the registration process, you shall be solely responsible for maintaining the confidentiality of your password and security of your account. Accordingly, you are solely responsible for all activities that occur under your account. Without limiting the generality of the foregoing, you will in particular: 1. immediately notify us of any unauthorized use of and access to your account and any other breach of security in connection therewith; and 2. ensure that you log out from your account by the end of each use. We shall not be held responsible for and shall not assume any liability for any loss or damage arising from and/or in connection with your failure to comply with the aforesaid.

3. Children

We shall not use the Websites to knowingly solicit information from or market to children or young persons under the age of 18.

If you are under the age of 18, you must let your parent or guardian know about the Privacy Policy Statement before you use the Websites and their services.

5. Sale and Purchase

A. We will sell and deliver the Goods to end user customers only. You confirm and warrant that your Order of Goods is for your personal use as an end user, and not for resale to any third party or for any other commercial purposes whatsoever. We reserve the right to decline your Orders if we reasonably believe that your purchase of Goods is not for your personal use as an end user.

B. We may take into account the membership account (i.e. the e-mail address) through which such Orders are placed, the credit/debit card used for payment thereof, your Internet protocol (IP) address and such other distinctive aspects of such Orders, whether independently or collectively, in tracing and/or identifying the Orders placed by you. If any dispute arises under an Order, our determination will be final and conclusive.

C. All images of Goods are for reference purpose only. The actual colour, size and shape depend on the Goods itself.

6. Placing Orders

A. The online shopping facility on the Websites is available only to registered members of the Websites. All orders that you placed in the Website will only be accepted subject to the Terms.

B. Shopping Guide
If you are looking for your favorite goods, you can browse by a product category from the menu or use the search bar at the top of our website. You can place a selected product to your shopping cart and choose to continue shopping. Once you have selected all the goods you wish to purchase, click the image of shopping cart at the top right corner of the page and you will be directed to the checkout page on which you can enter your shipping information and make the payment.

C. The orders made by you constitute an offer on your part to purchase. We shall have the absolute discretion to accept or reject your orders without giving any reasons.

D. All orders are subject to stock availability and confirmation of the order price. No contract of sale and purchase of goods exists between you and us until we have received and accepted your order and sent you an email ("Order Confirmation") to confirm that the goods you ordered have been dispatched or (if you have selected the in-store collection service) that your order is ready for collection. Once we have sent you an Acceptance Email, there is a binding legal contract between you and us. The contract shall be deemed to be entered into in Hong Kong.

E. We may refuse any purchasing order which we suspect is for commercial resale. All of our goods sold are for customers' use only and shall not be commercially resold.

F. Notwithstanding any provision to the contrary, we reserve the right to refuse processing or fulfilling an Order (whether accepted or not) in the event that any lawful reason arises or any circumstance not within our control or expectation occurs which prevents or restricts us from delivering the goods under such Order or which otherwise renders us unable to fulfill or perform such Order. In such an event, we shall refund to you the amount already paid by you for such goods into your credit/debit card account (excluding any fees charged by banks, credit/debit card companies or other service providers). Any gift with purchase or member’s points will have to be returned or forfeited.

G. You are responsible for ensuring the completeness and correctness of all information provided in connection with your Order. We shall not be liable for any failure or delay in discharging our obligations or performing our duties under a Contract if such default is related in any way to incomplete, incorrect or misleading information provided by you. You undertake to indemnify and hold harmless to us, our officers, agents, employees, contractors, other representatives and affiliated companies (including but not limited to our holding companies, subsidiaries and group members) from and against all claims, losses, damages, charges, taxes, duties, costs and expenses incurred or suffered as a result of your provision of incomplete, incorrect or misleading information. As a result of incomplete or inaccurate of all information submitted by you, In the event that we cannot send out the goods within three months from the payment date as a result of incomplete or inaccurate information submitted by you, we shall cancel your orders, and the amount already paid by you shall be forfeited to us in full, and we shall have the absolute discretion to dispose the goods.

7. Payment Terms

A. Unless otherwise specified by us, all prices quoted on the Websites are in Hong Kong dollars and are subject to adjustment at our absolute discretion from time to time without prior notice to you.

B. Prices are exclusive of any and all applicable shipping fees, delivery charges, handling fees, insurance charges and Taxes.

C. Goods are subject to availability. As there is a delay between the time when your order is placed and the time when the order is accepted, the stock position relating to any particular items may change. If an item you have ordered becomes out of stock before the issuance of the Acceptance Email we shall notify you as soon as practicable and we shall refund to you the payment for the price of the goods you have made for the out of stock item. We shall not be responsible for any additional payment arising therefrom or in connection therewith.

D. Whilst we endeavor to avoid errors in pricing and product information, however, if a mistake still occurs, we reserve the right and absolute discretion to correct it, refuse or cancel any Order placed, or terminate the relevant Contract.

E. Unless otherwise specified by us, payment for goods will be effected in Hong Kong dollars by way of credit/debit card accepted on our issuance of the Acceptance. You hereby represent and warrant that you are the legitimate holder of the credit/debit card used for payment for the goods. If the credit/debit card is not denominated in Hong Kong Dollars (HKD), the relevant exchange rate and the consequential final price charged in your currency will be calculated by your issuing bank or card provider. In this connection, you confirm that we shall not assume any responsibility whatsoever.

F. Your credit/debit card payment will be processed by such service provider as we may engage from time to time (“Payment Processor”). Your credit/debit card particulars will be passed onto the relevant financial institution through the Payment Processor. We do not and will not retain any of your credit/debit card particulars.

G. Payment Methods
At this time, we accept the following payment methods:

H. All payments for goods will be debited immediately when the order is placed. By placing an order using one of the above payment methods, you confirm that the payment instrument used is yours or that you have been specifically authorized by the owner to use it. If the issuer of your payment instrument refuses to authorize payment to us, your order shall be deemed to have been rejected by us immediately.

8. Shipping and Pick Up

A. Subject to full payment in accordance with the provisions herein (the order of which has been accepted by us), we will follow up the Shipping/ Pick Up issue with you within three working days after the acceptance of the order.

B. Shipping Methods & Timeline
Door to door delivery:
We shall directly send the item to the delivery address provided by you when the order is filled in. The delivery service is not available to closed areas, hotels and post office box address.

Timeline:
While we endeavor to have goods delivered to you as soon as practicable, we make no guarantee or warranty as to the delivery date and time of the goods which may be affected by matters outside of our reasonable control or any other factors or uncertainties, including without limitation customs clearance procedures.

Time of delivery of the goods will not be of the essence and is only our best estimate. Under no circumstances will we be liable to you for any delay (however caused) in respect of the delivery of the Goods (whether or not the same has been notified to you).

C. We require a signature for any goods delivered or collected, at which point the risk of loss of the goods passes to you. If the recipient or collector is not the original purchaser, such as in the case of a gift delivery, then you agree that the recipient’s signature shall constitute evidence of delivery and fulfillment of your order, as well as the passing of risk.

D. Please note that if our goods are returned because of undeliverable address, we shall refund to you the amount already paid by you for such goods into your credit/debit card account (excluding any fees charged by banks, credit/debit card companies or other service providers). Any gift with purchase or member’s points will have to be returned or forfeited.

9. Exchanges

In the hope that customers can make purchase in a carefree manner, we offer 7-day exchange guarantee for items that are in their original conditions (pre-order or engraved items are excluded). This Exchange Policy is applicable to our King Fook e-shop website orders only and not for purchases at any physical store, and subject to the following conditions:-

A. If you intend to make a request of exchanging the item, you have to make the request by our website “ contact us” within 7 days upon the receipt of the item. Exchange of item will be arranged with the customer accordingly. Please state clearly in our webpage the order number, receipt number, item number and reason for exchange. We shall normally send a reply email in confirmation of the receipt of your email requesting for exchange of item within one business day after we received such notification.

B. All items, that have not been used or worn, may be exchanged for any size under the same product as designated by us based on stock availability.

C. If the value of the selected replacement item(s) is/are higher than that of the original purchase (determined based on weight and labour costs for non-fixed price gold jewellery, and based on the selling price of the merchandise for other jewellery), you will pay us the difference in price. Where the value of the item is higher than that of the selected replacement item, we shall not refund to you the price difference.

D. The Goods with the original invoice must be returned to us in-person at any King Fook or masterpiece by king fook stores within 14 working days from the date of the aforesaid acknowledgement for exchange procedures provided however that you shall be solely responsible for the costs and expenses of returning the Goods to us and ensure the safety of the Goods during such return. No Goods can be exchanged more than once.

E. The Goods returned, with all relevant warranties, authenticity cards and original invoice intact, must be in original condition and packaging and must not and have not been used or worn. If you do not receive any acknowledgement from us within the aforesaid 1-day period, you shall be responsible to call our customer service hotline to lodge your claim within 7 days following the date of Goods collection or delivery of the Goods.

F. Not all Goods are suitable for resizing or length adjustment and prior to your order being made, you should check with our Customer Service Centre to find out if resizing or length adjustment is possible for the Goods you are purchasing. We have the absolute discretion to decide whether any Good is suitable for resizing or length adjustments.

10. Return Guarantee

In the hope that customers can make purchase in a carefree manner, we offer 7-day money back guarantee for items that are in their original conditions (pre-order or engraved items are excluded). This Return Policy is applicable to our King Fook e-shop website orders and not for purchases at any physical store, and subject to the following conditions :-

A. If you find our product dissatisfied out of any reason and request for returning the item, you have to make the request by “contact us” within 7 days upon the receipt of item. Late request will not be accepted. If you have not collected the product, we will arrange the return of payment accordingly. If you have collected the product, we will inform you to return the product to our shop for verification.

B. Please state clearly in the“contact us” the order number, receipt number, item number and reason for returning. We shall normally send a reply email in confirmation of the receipt of your email requesting for return of the item within one day after we received such notification. Having looked into the matter, we shall inform you of the relevant arrangements by email.

C. If you do not receive our confirming email mentioned above within one day, you shall be responsible to call our customer service officer to make your request of returning the item within 7 days from the day when the item is collected or delivered to you(as the case may be). Please retain sales invoice, packing box and all the accessories in the packing box. Customer should return the item in-person at any King Fook or masterpiece by king fook stores during business hours. (Business hours: Monday to Sunday from 11:00am to 7:30pm)

D. Return Procedure
In order to protect customers, we suggest customers should follow the procedures below to return item after receiving the confirmation.

Step 1 - Take photo of the item to be returned for record.
Step 2 - Pack the item with the original packing materials, enclosed with sales invoice and other accessories.
Step 3 - Return the item in-person) to any King Fook or masterpiece by king fook stores during business hours.
(Business hours: Mondays to Sunday - 11:00 a.m. to 7:30 p.m)
*Customer shall return the item in-person and be responsible for the safe delivery of the item
Step 4 - We shall send an email to confirm the item is received.
Step 5 - When the item is found intact following an examination, our Finance Department will apply to the bank for refund
Step 6 - Bank will normally return the payment within 30 working days to the relevant credit card account
Step 7 - We shall refund to you the amount already paid by you for such goods into your credit/debit card account (excluding any fees charged by banks, credit/debit card companies or other service providers). Any gift with purchase or member’s points will have to be returned or forfeited.

E. The right of returning shall be claimed once every 6 months only for each delivery address or user ID.

F. All chuk kam (足金) bars, gold jewellery, gold nuggets, gold coins, clock and watches, gold ornament etc. are not refundable nor exchangeable.

11. Repair and Maintenance Services

You should return to us in person at any King Fook or masterpiece by king fook stores at your own risks for repair and maintenance services at our then current prices and on such terms as we may advise. You may consider effecting insurance for your shipment of the repaired or maintenance goods, but any such insurance will be obtained at your own cost and/or risk.

We shall not be responsible for any losses, direct or otherwise, that may arise from loss or damage of the Goods arising from or in connection with the shipment, repair or maintenance of the Goods.

12. Online Customer Service

Online customer service (“Online Customer Service”) will be available from 9:00 a.m. to 6:00 p.m. local time in Hong Kong every day (except Saturdays, Sundays and public holidays in Hong Kong) or at such other times as we shall in our discretion deem appropriate. While we endeavor to respond to each and every enquiry that you post as soon as possible, we shall not be responsible and/or liable for any delayed response or omission to respond.

No statement or information given during the Online Customer Service constitutes an offer to sell any goods, or a representation, condition, warranty or undertaking (express or implied) given by us.

13. Intellectual Property Rights

A. This Website and any information available on it including, but not limited to, text, graphics, icons, images, software, source code and trademarks, are protected by copyright, design, trademark and other Intellectual Property Rights owned or controlled by us and/or our licensors. You may not copy, reproduce, republish, upload, download, post, transmit, store in retrieval system, modify, alter or display in public or distribute in any way the contents or any part of this Website for any purpose without our prior written permission except that you may download materials displayed on the site for non-commercial, home and personal use only as long as you keep all copyright, trade mark and other proprietary notices intact.

B. All right, title and interest in the Intellectual Property Rights in this Website shall at all times remain the property of us and/or our licensors. Customers and visitors are not authorized to use the same unless you have obtained express prior written permission from us and/or our licensors, as the case may be.

14. Limitation of Liability

By accessing and using this site you acknowledge and accept that the use of the Website is at your own risk. We shall not be liable for any direct, indirect, incidental, consequential or punitive damage or for damages for loss of profit or revenue arising out of any use of, access to, or inability to use or access the Website. Without limiting the foregoing:

15. Force Majeure

If the performance by us of its obligations under our website is prevented by reason of "force majeure" (which shall include prevention occasioned by fire, casualty, accident, act of God, natural disaster, any law, order, proclamation, regulation, demand or requirement of the Government of the Hong Kong Special Administrative Region or of any of its government agencies, strikes, labour disputes, shortage of labour or lack of skilled labour, shortage or unavailability of goods or raw materials, delay in transit or other causes whatsoever (whether similar to the foregoing or not) beyond the reasonable control of us), We shall be excused from such performance to the extent of such prevention.

16. Applicable Law

These Terms and Conditions shall be governed by the laws of the Hong Kong Special Administrative Region and both you and we agree to submit to the jurisdiction of the Hong Kong courts.
